Terms and Conditions

These terms and conditions apply to Pilates classes and related services provided by Jade Carey, at Jade’s Pilates Studio ("the Studio", "we", "us" or "our").

By booking or attending a session, you confirm that you have read and agree to these terms and conditions, together with the Client Consent and the Studio’s Privacy Notice.

1. Our services

We provide private, duet and small-group Pilates classes from the Studio. Classes are intended to support general fitness and wellbeing and are not medical treatment, physiotherapy or a substitute for professional medical advice. We may adapt exercises, equipment or teaching arrangements where reasonably necessary for safety or effective instruction. All sessions are approximately one hour unless stated or agreed otherwise.

2. New clients

All new clients begin with a private introductory session. Completion of this introductory session is required before booking a small-group class unless otherwise agreed.

3. Client eligibility and health information

Before attending your first session, you must complete our health questionnaire accurately and tell us about any:

  • Injury, illness or medical condition that may affect your ability to exercise safely.

  • Pregnancy, recent birth or surgery relevant to your participation.

  • Change in health, medication or symptoms occurring after your initial questionnaire.

You are responsible for obtaining medical clearance where a doctor or other qualified healthcare professional has advised you to do so. We may decline, pause or modify your participation where we reasonably believe this is necessary for your safety or the safety of others. If you experience pain, dizziness, breathing difficulty or unusual discomfort, stop exercising and tell the instructor immediately.

4. Bookings

All sessions must be booked in advance. A booking is confirmed once accepted and payment has been made. Places in small-group sessions are limited to a maximum of three clients. Bookings are personal to the named client and may not be transferred to another person without our prior agreement.

5. Payment

Payment is due at the time of booking or upon receipt of an invoice. Invoices are due by the payment date stated on the invoice. Prices may change, but a change will not affect a booking already confirmed and paid for. Package or membership price changes will be communicated in advance.

6. Client cancellations and missed sessions

Please provide at least 24 hours’ notice if it is necessary to cancel or rearrange a session. Where sufficient notice is provided, the booking may be credited, rearranged or refunded in accordance with the package purchased. Where no notice or less than 24 hours' notice is provided, the session will normally be charged in full or deducted from your package.

7. Statutory cooling-off rights

Where you purchase sessions online by telephone or away from our business premises, you may have a legal right to cancel within 14 days, subject to statutory rules and exceptions. If you ask us to begin providing services during that period, you may be required to pay a reasonable amount for sessions supplied before cancellation. If a service has been fully performed after your express request and acknowledgement, the statutory cancellation right may end. To exercise an applicable statutory right, contact us at hello@jadespilates.com and clearly state that you wish to cancel.

8. Studio cancellations

We may cancel or rearrange a session because of instructor illness, an emergency, unsafe conditions or another event outside our reasonable control. Reasonable notice will be given wherever possible and the client will not be charged for that session or will be offered an alternative session, as appropriate.

9. Arrival and conduct

Please arrive 5-10 minutes before your session. Late arrival may shorten your session so that later bookings are not disrupted, and the full session fee will remain payable. If a client is significantly late, the instructor may determine that it is not appropriate or safe to complete the planned session.

Clients must:

  • Follow reasonable safety instructions given by the instructor.

  • Use equipment only as directed.

  • Wear suitable clothing and grip socks, if required.

  • Treat the instructor, other clients, neighbours and property respectfully.

  • Avoid attending while affected by alcohol, recreational drugs or anything else that makes exercise unsafe.

10. Illness and infection

Please do not attend if you have a contagious illness or symptoms that may create a significant risk to others. Where possible, please contact hello@jadespilates.com as soon as possible to rearrange your session.

11. Home-studio arrangements

The Studio operates from a private residential property. Please:

  • Attend only at your booked time.

  • Follow the parking and access instructions provided.

  • Remain within areas identified for client use.

  • Keep noise to a reasonable level and respect our neighbours.

  • Do not bring children, guests or pets unless agreed in advance.

12. Parking

Please tell us in advance if you wish to park on our driveway as we have automated entry gates. Free parking is also available on the surrounding roads. Vehicles and personal belongings are left at the owner's risk, subject to our legal responsibilities.

13. Personal belongings

Please keep personal belongings secure. We are not responsible for loss, theft or damage unless it results from our failure to use reasonable care or another liability that cannot legally be excluded. Please tell us promptly if you believe property has been lost or damaged at the Studio.

14. Exercise risks and responsibility

Pilates and physical exercise involve an inherent risk of discomfort or injury. You agree to follow instructions, work within your capabilities and notify us if an exercise feels unsafe or unsuitable.

Nothing in these terms excludes or limits liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Breach of your statutory consumer rights.

  • Any other liability that cannot legally be excluded or restricted.

Subject to those protections, we are not responsible for injury or loss caused by information you failed to disclose, your failure to follow reasonable instructions, or your deliberate or reckless conduct.

15. Instructor qualifications and insurance

Sessions will be delivered by Jade Carey, a STOTT Pilates certified instructor. We maintain public liability/professional indemnity insurance appropriate to our activities.

16. Photography and recordings

You may not photograph, film or record a session without our prior permission and the consent of anyone who may appear in the recording. We will not use identifiable photographs or recordings of you for marketing without your separate, voluntary consent.

17. Personal information

We use personal information to manage bookings, payments, communications, safety and the delivery of our services. Health information receives additional protection and will be collected and used only where we have an appropriate lawful basis. More detail is provided in our Privacy Notice. Marketing messages will be sent only where permitted, and you may unsubscribe at any time.

18. Changes to these terms

We may update these terms for legal, safety or operational reasons. Changes will not normally apply retrospectively to completed bookings.

19. General provisions

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not mean that the right has been waived. No person other than you and us has a right to enforce these terms, except where the law provides otherwise. These terms do not affect your statutory consumer rights.

20. Governing law

These terms are governed by the laws of England and Wales. Any dispute may be dealt with by the courts that have jurisdiction under applicable consumer law. If you live elsewhere in the UK, you may generally be entitled to bring proceedings in the courts of the part of the UK where you live.
